1. Acceptance of Terms
By accessing and using Mechanics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service. We reserve the right to update these terms at any time. Your continued use of the Service following changes means you accept the new terms.
2. Description of Service
Mechanics is a cloud-based shop management software designed for auto-repair shops and mechanics. The Service provides tools for creating and managing work orders, generating professional estimates and invoices, tracking inventory, processing point-of-sale transactions, and using AI-powered diagnostic assistance. These features are provided on an as-is basis to help you run your shop more efficiently.
3. Accounts & Eligibility
You must be at least 18 years old and a legal resident of a jurisdiction where the Service is offered to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are solely responsible for any damages or losses resulting from unauthorized use of your account.
4. Subscriptions, Billing & Trials
Pricing Plans: Mechanics is offered under two subscription plans: Personal ($29/month) and Pro ($149/month). Pricing and features are subject to change with 30 days' notice.
Free Trial: New users receive a 14-day free trial with full access to the Service. Credit card information may be required to start a trial. Your subscription will automatically convert to a paid plan after the trial ends unless you cancel beforehand.
Billing: Subscriptions are billed monthly via Stripe. Billing occurs on the same day each month. If your payment fails, we may suspend your account until payment is received.
Cancellation: You may cancel your subscription at any time through your billing portal in the dashboard. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods except as required by law.
5. Payment Processing for Shops
Mechanics facilitates shop owners in connecting their own Stripe or Square merchant accounts to accept customer payments. Mechanics is not a party to any transaction between your shop and your customers. You are solely responsible for processing payments, tax collection, refunds, chargebacks, and any disputes. Mechanics does not hold, process, or have access to your customer payment data except as necessary to route your transaction to your connected payment processor. You are responsible for compliance with all payment processor terms and applicable payment card industry standards.
6. Customer Data & Ownership
You retain all ownership and control of your data, including customer information, vehicle records, work orders, invoices, inventory, and estimates. Mechanics stores and processes this data solely to provide the Service. You grant Mechanics a limited license to use your data for hosting, backup, analytics, and service improvement. You are solely responsible for ensuring you have the right to collect and store customer data, and for complying with all applicable privacy laws regarding that data.
7. Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of any applicable laws or regulations. Specifically, you agree not to:
- Upload malicious code, viruses, or malware
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or attempt to derive the source code of the Service
- Use the Service for spam, phishing, or fraudulent purposes
- Collect or process data in violation of privacy laws or the rights of others
- Violate intellectual property rights or other proprietary rights
8. Intellectual Property
Mechanics and all related content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Mechanics, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these terms, you may not reproduce, distribute, transmit, display, or otherwise use any content from the Service without permission.
9. AI Features & Diagnostics
Mechanics provides AI-powered diagnostic suggestions to assist you in identifying vehicle issues. These suggestions are generated automatically and are for informational purposes only. They are not a substitute for professional mechanical diagnosis or advice. You must not rely solely on AI diagnostic output for safety-critical repairs or warranty decisions. Always verify AI suggestions through your own inspection, experience, and professional judgment. Mechanics makes no warranty that diagnostic suggestions are accurate, safe, or appropriate for any specific vehicle or situation.
10. Disclaimers & Warranties
AS-IS BASIS: The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. Mechanics disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
NO GUARANTEE: Mechanics does not guarantee that the Service will be uninterrupted, error-free, or free from viruses or harmful components. We do not guarantee that the Service will meet your specific requirements or that any defects will be corrected.
NO LIABILITY FOR THIRD PARTIES: Mechanics is not responsible for the actions, content, or services of third-party payment processors, hosting providers, or other integrations.
11. Limitation of Liability
To the fullest extent permitted by law, Mechanics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of revenue, profit, or business opportunity
- Loss of data or data corruption
- Business interruption or downtime
- Reputational harm
- Any other losses arising from your use or inability to use the Service
The total liability of Mechanics for all claims arising out of or relating to the Service shall not exceed the fees you paid to Mechanics in the 12 months preceding the claim. Some jurisdictions do not allow the limitation or exclusion of liability, so these limitations may not apply to you.
12. Termination
You may terminate your account at any time by canceling your subscription. Mechanics may terminate or suspend your account immediately, without notice, if you violate these terms, engage in unlawful activity, or abuse the Service. Upon termination, your right to access the Service ceases immediately. You remain liable for any fees owed through the end of your current billing period. Data retention policies are detailed in our Privacy Policy.
13. Changes to Terms
Mechanics reserves the right to modify these terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service following changes constitutes acceptance of the new terms. If you do not agree with any changes, your sole remedy is to discontinue use of the Service.
14. Governing Law
These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in California for resolution of any disputes arising from or relating to these terms or the Service.
